GENERAL TERMS AND CONDITIONS OF SALE AND USE

1. Purpose and scope of application
These General Terms and Conditions of Sale (hereinafter, “Terms and Conditions of Purchase”) govern the sale of products offered by ART SUN BCN, S.L., with registered address at Agulles, 4 08003 Barcelona, through the website www.gabrielpinos.com.
The purchase of any product through the website implies full and unreserved acceptance of these Terms and Conditions of Purchase, as well as the Privacy Policy and the Cookies Policy.
Terms:
Customer: natural or legal person who purchases one or more products.
Contract: contract for the sale of products offered on www.gabrielpinos.com.
LGDCU: Royal Legislative Decree 1/2007 (Defense of Consumers and Users).
LSSI: Law 34/2002 on Information Society Services and Electronic Commerce.
Products: items offered in the online store.
User: person who accesses the website.
2. Prices
The prices shown on the website are exclusively for online purchases and include taxes (VAT). Shipping costs and insurance will be added at the time of purchase.
www.gabrielpinos.com reserves the right to modify its prices at any time, undertaking to apply the rate in force at the time the order is placed.
3. Product availability
Most of the works and objects sold are unique and non-reproducible items.
All products offered are subject to availability.
If an item is unavailable, the customer will be informed within a maximum of 48 hours. An alternative product may be offered or an immediate refund may be issued.
All artwork is sold framed as standard. We reserve the right to substitute the frame depicted on the website with an alternative frame of equal or greater quality in the event the original frame is damaged, discontinued, or otherwise unavailable. Consequently, the final overall dimensions of the framed artwork may vary minimally from those listed on the website. Any such substitution will be made with the sole intention of maintaining or enhancing the customer's overall experience and the presentation of the artwork.
4. How to buy and shopping cart
The purchase procedure is available in Catalan, Spanish, and English.
Products can be added to the cart without prior registration. Before confirming the purchase, it will be necessary to register or provide the required information.
Quantities can be modified or products removed directly in the shopping cart.
5. Payment methods
The following payment methods are available:
1- Credit/debit card (Visa, Mastercard, etc.). Secure payment via bank gateway (SSL).
2- PayPal: fast and with access to transaction history.
6. Shipping, delivery, and delivery times
Shipping available to Spain, Europe, and other international destinations.
Estimated delivery times are 7 to 10 business days. We are not responsible for delays caused by third parties.
In the event of an incident, no reshipments or refunds will be made while an investigation is ongoing with the transport company.
7. Acknowledgment of receipt
Once the contract has been formalized, the customer will receive a confirmation acknowledgment within a maximum of 24 hours.
8. Right of withdrawal and returns
The customer may withdraw from the contract within 14 calendar days of receiving the order, without needing to provide a reason.
Withdrawal must be communicated to info@gabrielpinos.com.
Refunds will be made within a maximum of 14 calendar days, using the same payment method, unless otherwise agreed.
Return shipping costs are the responsibility of the customer, except in cases of defective or non-compliant products.
Only products in their original packaging and in perfect condition will be accepted for return.
9. Warranties
All products have a 2-year legal warranty in accordance with the LGDCU.
In the event of non-compliance, the customer may request repair, replacement, price reduction, or termination of the contract.
Works of art are accompanied by a certificate and also have a guarantee of authenticity and uniqueness.
10. Security and confidentiality
Transactions on www.gabrielpinos.com are carried out under SSL protocol.
The personal data collected is processed in accordance with the Privacy Policy published on the website.
Uninterrupted access to the website, or the absence of errors or viruses, is not guaranteed.
11. Retention of title
Ownership of the products is transferred only after full payment of the price. The risk of loss or damage is transferred at the time of delivery to the customer.
